WPC Water Tests Privacy Policy

This Privacy Policy (“Privacy Policy”) is between you and ePoolSupply LLC (“ePoolSupply,” “we,” “us,” or “our”) and describes how ePoolSupply collects, uses, stores, shares, protects, and deletes information in connection with Weekly Pool Care Water Testing, also referred to as WPC Water Tests.

WPC Water Tests is an internal company system owned and operated by ePoolSupply. It is used to record water test results, maintain customer and pool/spa records, generate reports, and provide rule-based recommendations. This Privacy Policy applies to information collected in, through, by, or for WPC Water Tests, including information provided in connection with water testing services, employee-entered records, printed or emailed reports, support communications, and related customer service.

Although this Privacy Policy is customer-facing, it also applies to employees, approved contractors, and other authorized users who access, enter, review, use, or handle information through WPC Water Tests.

By using our water testing services, submitting information for use in WPC Water Tests, requesting access to records or reports generated through WPC Water Tests, or otherwise interacting with ePoolSupply in connection with WPC Water Tests, you acknowledge that information may be collected, used, stored, shared, and deleted as described in this Privacy Policy.

What Information Does ePoolSupply Collect?

ePoolSupply may collect information that you provide directly, information entered by employees or authorized users, information generated through water testing and reporting, and technical or system information related to the operation of WPC Water Tests.

Information collected through or in connection with WPC Water Tests may include, but is not limited to:

  • Name
  • Email address
  • Phone number
  • Other customer-provided identifying or contact information reasonably related to water testing or customer service
  • Pool/spa nickname or label
  • Pool/spa type
  • Surface type
  • Sanitizer type
  • Pool/spa size or gallons, if provided or estimated
  • Water test readings
  • Water test dates and history
  • Reports
  • Recommendations
  • Employee notes, observations, or service comments related to water testing, water health, pool/spa condition, recommendations, or customer service
  • Anonymous customer IDs
  • Account and record activity
  • Report generation activity
  • System logs, error logs, timestamps, and other technical or administrative information.

ePoolSupply does not ordinarily collect customer addresses through WPC Water Tests. Customers should not provide information that is not needed for water testing or related customer service.

Customers should not provide Social Security numbers, payment card numbers, medical information, government IDs, unrelated private details, or other information that is not relevant to water testing, pool/spa service, reports, recommendations, or customer service.

If you choose to provide information, you should provide accurate information. You should not provide false, misleading, or improper information, and you should not provide information that belongs to another person unless you are authorized to do so.

Are Customers Required to Provide Identifying Information?

No. Customers are not required to provide a real name, email address, or phone number to receive a water test.

Email is our primary form of communication, and an email address is often the most useful identifier for locating records and providing future customer service. However, customers may decline to provide identifying information.

If a customer does not provide a real email address, ePoolSupply may create an anonymous customer record.

Anonymous Customer Records and Anonymous IDs

An anonymous customer record is any customer record in WPC Water Tests that is not associated with a real customer email address. An anonymous customer record may still include other information, such as a name or phone number, if the customer provides it.

Anonymous customer records use an 8-digit anonymous ID and a pseudo-email created for system purposes. The anonymous ID is the primary way to retrieve an anonymous record later.

Customers who use an anonymous record should keep their anonymous ID if they want future access to the water test records connected to that anonymous record. Anyone who provides the anonymous ID may be able to access the water test records associated with that anonymous record through an employee. Customers should not share an anonymous ID with anyone they do not want to have access to those records.

If a customer loses the anonymous ID, ePoolSupply may not be able to retrieve the anonymous record unless other identifying information exists on the account, such as name or phone number.

How Does ePoolSupply Use Information?

ePoolSupply may use information collected in, through, by, or for WPC Water Tests for legitimate business purposes, including but not limited to:

  • Performing and recording water tests
  • Creating and maintaining customer records
  • Creating and maintaining pool/spa records
  • Maintaining water test history
  • Generating reports
  • Generating rule-based recommendations
  • Providing water testing services
  • Helping customers retrieve current or past test results
  • Communicating with customers about water tests, reports, records, or related customer service
  • Responding to customer questions, requests, corrections, or deletion requests
  • Supporting, maintaining, troubleshooting, and improving WPC Water Tests
  • Protecting against misuse, improper access, security issues, or system problems
  • Reviewing account access, record activity, system activity, and employee use
  • Enforcing company policies and system rules
  • Complying with legal, security, operational, or business requirements

ePoolSupply does not currently use information collected through WPC Water Tests for marketing purposes.

Recommendations generated through WPC Water Tests are company-generated guidance based on information entered into the system. Recommendations are not treated as private customer information by themselves. However, reports or records that connect recommendations to a customer account, pool/spa record, anonymous ID, or water test should be handled according to this Privacy Policy.

Reports and Recommendations

WPC Water Tests may generate reports and recommendations based on water test results, pool/spa information, and system rules.

Reports may be printed, downloaded, emailed, or otherwise shared with the customer as part of water testing or customer service. ePoolSupply instructs employees to handle printed and downloaded reports carefully and not to keep downloaded reports longer than needed.

Recommendations are guidance tools only. They are not guarantees, warranties, or promises of a particular result. Recommendations may depend on the accuracy and completeness of the information entered into WPC Water Tests. Customers and employees should consider product labels, manufacturer instructions, safety warnings, applicable laws, pool/spa conditions, and appropriate professional judgment when using or relying on recommendations.

With Whom Does ePoolSupply Share Information?

Information collected in, through, by, or for WPC Water Tests may be accessed, used, or shared as described in this Privacy Policy.

ePoolSupply may share or make information accessible to authorized employees, approved contractors, managers, administrators, developers, support personnel, or other authorized personnel when needed for legitimate water testing, customer service, support, technical, security, operational, or business purposes.

Information may also be accessed by authorized employees of ePoolSupply’s parent company, Emerald Pool and Spa, for limited business purposes.

ePoolSupply may use third-party systems and vendors to operate, host, secure, maintain, back up, support, or communicate through WPC Water Tests. These systems and vendors may process, transmit, store, or make information available as needed to provide those services. For example, ePoolSupply may use hosting, storage, backup, email, security, technical support, maintenance, and related operational systems.

ePoolSupply may share reports or water test information with a customer or with a person who reasonably identifies the applicable customer account or anonymous record, unless the request appears suspicious, inappropriate, inconsistent, or unauthorized.

ePoolSupply may disclose information when we believe disclosure is appropriate to comply with law, respond to legal process, enforce this Privacy Policy or other company policies, protect the rights, property, or safety of ePoolSupply, customers, employees, users, or others, investigate suspected misuse, prevent fraud or security issues, or maintain the integrity and operation of WPC Water Tests.

If ePoolSupply, its assets, its ownership, or its business operations are sold, transferred, merged, reorganized, or otherwise changed, information related to WPC Water Tests may be transferred as part of that transaction, subject to applicable law.

ePoolSupply does not sell customer personal information or water test history.

Access, Correction, and Deletion Requests

Customers may request access to or copies of their water test records or reports if they can reasonably identify the applicable account or anonymous record.

Customers may request correction of inaccurate customer, pool/spa, or water test information. ePoolSupply may require the customer to reasonably identify the applicable account or anonymous record before making corrections.

Customers may request deletion of their account. To request deletion, the customer must properly identify the account and submit a written deletion request by email or in person on paper.

If a customer properly identifies their account and submits a written deletion request, ePoolSupply will delete the customer account within 72 hours unless a legitimate legal, security, technical, operational, or business reason requires further review. Water tests connected to that customer account will be deleted along with the customer account.

For anonymous records, providing the anonymous ID with a written deletion request will generally be treated as sufficient to identify the anonymous account for deletion, unless the request appears suspicious, inappropriate, inconsistent, or otherwise requires further review.

Deletion applies to active customer records in WPC Water Tests. Deleted information may remain temporarily in backups, logs, security records, technical records, or archival records until those records are overwritten, deleted, or no longer needed. ePoolSupply’s backup, logging, and technical retention practices may change over time.

Data Retention

ePoolSupply may keep WPC Water Tests records for as long as reasonably useful for water testing history, customer service, recordkeeping, business operations, security, troubleshooting, legal compliance, system maintenance, or related legitimate purposes.

Customer records are not automatically deleted merely because a customer stops using water testing services. Records may continue to exist unless deleted in response to a valid customer request or for another legitimate company, technical, operational, legal, or business reason.

Account and System Activity

WPC Water Tests may track and record activity in the system. This may include logins, account access, customer record activity, pool/spa record activity, water test activity, report generation, edits, deletions, permission changes, administrative actions, errors, and other system events.

System activity may be reviewed for legitimate company purposes, including security, troubleshooting, training, customer service, correcting mistakes, investigating suspected misuse, reviewing access, maintaining the system, and improving the software.

Employee access to WPC Water Tests is role-based and limited to authorized company purposes. Employees and other authorized users should not expect activity in WPC Water Tests to be private from ePoolSupply.

Information Security

ePoolSupply takes reasonable steps to protect information collected in, through, by, or for WPC Water Tests. We use administrative, technical, and operational safeguards intended to reduce the risk of unauthorized access, disclosure, misuse, alteration, or loss.

However, no system, database, website, software application, email system, transmission method, or storage method can be guaranteed to be completely secure. ePoolSupply does not warrant or guarantee the absolute security of any information submitted to, stored in, transmitted through, or generated by WPC Water Tests.

If ePoolSupply becomes aware of a security incident involving information covered by this Privacy Policy, ePoolSupply will review and respond to the incident as appropriate and will provide notices as required by applicable law, including Arizona law where applicable.

Third-Party Systems and Links

WPC Water Tests or related communications may rely on or interact with third-party systems used for hosting, storage, backup, email, security, maintenance, support, or related operational purposes. This Privacy Policy applies to ePoolSupply’s handling of information in connection with WPC Water Tests.

If a communication, report, website, or service links to or interacts with a third-party website, application, or service not controlled by ePoolSupply, the privacy policy and terms of that third party may apply to that third-party website, application, or service. ePoolSupply is not responsible for the privacy practices of third-party websites, applications, or services that it does not control.

Children’s Privacy

WPC Water Tests is not intended for use by children. ePoolSupply does not knowingly collect personal information from children through WPC Water Tests, and we request that children under the age of 13 not submit any personal information through WPC Water Tests.

If ePoolSupply learns that it has collected personal information from a child in a way that is not appropriate for the system or the service, ePoolSupply may delete or restrict that information as appropriate.

United States Operations

WPC Water Tests is operated from the United States. Information collected in, through, by, or for WPC Water Tests may be stored, processed, transmitted, and backed up in the United States.

If you access or use services connected to WPC Water Tests from outside the United States, you understand that your information may be processed and stored in the United States, where privacy and data protection laws may differ from those in your location.

Changes to This Privacy Policy

ePoolSupply may update this Privacy Policy from time to time. Updates may be made to reflect changes in WPC Water Tests, company procedures, legal requirements, business needs, system features, security practices, retention practices, or other operational needs.

Any changes to this Privacy Policy will become effective when posted, published, distributed, or otherwise made available by ePoolSupply, unless a different effective date is stated. Continued use of water testing services, submission of information for WPC Water Tests, or requests for records or reports after a revised Privacy Policy becomes effective means that the revised Privacy Policy applies.

Governing Law; Disputes; Limitation of Liability

This Privacy Policy and WPC Water Tests are governed by the laws of the State of Arizona, except where applicable law requires otherwise.

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to this Privacy Policy, WPC Water Tests, or ePoolSupply’s handling of information under this Privacy Policy shall be brought in the state or federal courts located in Arizona, unless applicable law requires a different forum.

To the fullest extent permitted by law, you and ePoolSupply agree to waive any right to a jury trial in connection with disputes arising under or relating to this Privacy Policy.

To the fullest extent permitted by law, ePoolSupply shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to this Privacy Policy, WPC Water Tests, or the handling of information under this Privacy Policy.

To the fullest extent permitted by law, ePoolSupply’s maximum liability to you in connection with this Privacy Policy, WPC Water Tests, or the handling of information under this Privacy Policy shall not exceed one hundred dollars ($100). Some jurisdictions may not allow certain limitations of liability, so some of the above limitations may not apply to you.

Nothing in this Privacy Policy limits any rights or obligations that cannot be limited under applicable law.
